Feature Weddings Limited: Service Agreement & Terms and Conditions

Thank you for choosing Feature Weddings Limited (“Feature Weddings,” “we,” “us,” or “our”) for your special event.

By engaging our services for your wedding, you acknowledge that you have read, understood, and agreed to the following Terms and Conditions (“Agreement”). These T&Cs apply to all services we provide, including Photography, Videography, and Film, and take precedence over any contrary representations, whether oral or otherwise.

1. Agreement to Terms by Payment or Signature

To reserve your wedding date, a retainer of 50% of the total package price is required.
The Client (“you,” “your”) may confirm this Agreement either by signing the contract or by paying the deposit.

By paying the deposit, even if this document is not physically signed, you acknowledge that you have read, understood, and agree to be bound by all Terms and Conditions contained herein.
Payment of the deposit will be treated as full acceptance of this Agreement.

2. Payments & Booking Confirmation

2.1 Retainer Fee / Deposit
The 50% retainer secures your date exclusively. Once payment is made, that date is removed from our calendar for any other client.

2.2 Refund Policy
The retainer is fully refundable within 20 days of payment (less any non-recoverable expenses – $500).
After 20 days, the retainer becomes non-refundable but may be transferred to a new date (see Section 3).

2.3 Balance Payment
The remaining 50% balance is due no later than 7 days before your wedding week.
Late or missed payments may result in cancellation of services and forfeiture of the retainer.

2.4 Payment Methods
Payments may be made via bank transfer, credit card, or invoice link provided by Feature Weddings.

3. Changes, Postponements & Cancellations

3.1 Change of Date / Venue
You must notify Feature Weddings immediately of any change in date or venue.
If your new date is available, your booking will transfer.
If unavailable, the booking is treated as a cancellation.

If postponing (rather than cancelling), payments already made may be transferred to a new date (subject to availability). Any package price difference applies to the new booking.

4. Creative Control & Usage Rights

4.1 Exclusive Creator Agreement
Feature Weddings is the exclusive photography and/or videography provider for your event.
We ask that guests and vendors do not obstruct or interfere with our work.

4.2 Creative License
All creative decisions (style, tone, shot selection, editing) are at Feature Weddings’ professional discretion to maintain quality standards.

4.3 Copyright & Usage Rights
All media remains copyright of Feature Weddings Limited under NZ, AU, and Pacific Islands copyright law.
You are granted a perpetual, non-exclusive license for personal, non-commercial use (printing, personal sharing, and social media, with credit to Feature Weddings).

4.4 Portfolio Usage / Model Release
By entering this agreement, you grant permission for Feature Weddings to use selected imagery or video for promotional and portfolio purposes, including social media, website, and publications.

5. Delivery Timelines & Revisions

5.1 Delivery Schedule

• Photography: Delivery typically occurs between 40 – 80 days after the wedding.

• Videography / Film: Delivery typically occurs between 80 – 120 days after the wedding.

Delays may occur due to client feedback delays, peak-season workload, or unforeseen circumstances. We’ll communicate openly about progress.

5.2 Final Delivery Links
Final delivery links remain active for 60 days from the date sent. Clients are responsible for downloading and backing up all images and video.
Feature Weddings is not responsible for storing or archiving files after expiration unless separate archival arrangements are made.

5.3 Revisions Policy
Minor film revisions (colour, music sync, captioning) are included.
Major revisions requiring re-editing or storyline changes incur fees between $199 – $799 + GST, depending on scope.

6. Liability & Force Majeure

6.1 Best-Effort Clause
While every effort will be made to produce desired images and footage, specific shot requests cannot be guaranteed due to environmental or logistical factors.

6.2 Force Majeure
Feature Weddings is not liable for non-performance caused by acts of God, weather, illness, pandemic, travel restrictions, or events beyond reasonable control.
In such cases, we will offer to reschedule or refund any monies paid (minus non-recoverable expenses).

6.3 Limitation of Liability
Feature Weddings’ total liability for any claim shall not exceed the total fees paid by the Client.

7. Substitution & Team Members

If the lead photographer or videographer cannot attend due to illness or emergency, a qualified replacement will be provided.
Where a second shooter or additional team is included in your package, Feature Weddings will assign appropriate professionals.

8. Meals, Parking & Logistics

Clients agree to provide meals for crew when event coverage exceeds six hours.
Suitable parking and access must be provided.
Parking expenses exceeding $20 will be invoiced to the Client.

9. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Australia, New Zealand, and the Pacific Islands.
Any dispute shall be first addressed through mediation in the jurisdiction where the event occurred, and if unresolved, submitted to the courts of that region.

10. Entire Agreement & Amendments

This document represents the entire understanding between Feature Weddings Limited and the Client.
No amendment or modification is valid unless agreed to in writing by both parties.
Only the bride and groom (or listed signatories) may request modifications or discuss account details.
